SECURITY DEPOSIT: A refundable security deposit $200 is  required at the time of booking. This is to cover any loss or damage while you staying in the house. This will be returned in full 30 days after your departure from the house, if the management company reports no loss or damage. Should loss/damage occur, a deduction will be made to the amount of replacement/repair and the balance will be returned to you.

FULL PAYMENT:  The full payment and the security deposit are due 8 weeks prior to your arrival. We reserve the right to cancel your booking if payment is not received by this time.

CANCELLATION CHARGES:

a)      The Renter may cancel the booking at any time after it has been confirmed. Cancellation must be in writing in the form of a letter or an email.

b)      The following cancellation charges will apply to all rentals cancelled:

·   Over 90 days prior to check-in - $20 processing fee.

·   60 to 90 days prior to check-in – deposit retained as credit towards rental within one year.

·   30 to 60 days prior to check-in – 50% of rental.

·   Within 30 days - 100% of rental.

Note: We will not keep deposits/rental fees except $20 processing fee if the property can be re-rented. If the property is rented for a fraction of the original rental fee because it is posted as a late availability listing, the portion of the rent recovered will be refunded.

UNAVOIDABLE CHANGES: Owner reserves the right in any circumstances to cancel the booking and in this event we will return all sums (but without interest or compensation). In the event of a major change to the booking being necessary, owner will inform Renter as soon as reasonably possible, and if the Renter does not wish to accept the booking on this basis, we will cancel the booking and return all sums (but without interest or compensation).

LAWFUL PURPOSES: Renter agrees to use the premises exclusively for a private residence and in compliance with local municipal ordinances, board of fire underwriters’ rules and regulations, and for lawful purposes. In the event the premises are used at any time for unlawful purposes, at Owner’s option, the Owner may declare this Lease null and void.

DAMAGE TO RENTAL PROPERTY: In case the rental property is not returned in its normal condition, wear and tear from reasonable use expected, based on the inspection report, Owner shall supply Renter with an itemized list of charges.  Renter agrees to pay the cost of repair in full, not limited to the deposit amount.

LIABILITY: Owner shall not be liable for any loss or damage to personal property belonging to Renter, members of Renter’s family, servants, employees or visitors regardless how such damage or loss may arise and whether such property is contained in the leased premises, or any portion of the premises. Renter agrees to hold Owner harmless of any property claims. Owner is not liable for any damage to Renter regardless of the cause of damage. Owner shall not be liable for any personal injuries death sustained by the Renter, members of Renter’s family, servants, employees or visitors regardless how such injuries may occur. Renter agrees to hold Owner harmless from any such personal injury and death claims. Owner is not liable for any damage to Renter regardless of the cause of injury.

ARRIVAL/DEPARTURE: The property will be available to you from 4:00 p.m. on to the day you check in.  It must be vacated by 11:00 a.m. on the day of your departure. If you do need to check in early or check out late, you need to contact the owner to get permission, and a deduction ($10/hour) will be made from the security deposit.

POOL/SPA HEAT
If required this should be requested at the time of booking and paid for with the final balance.  In the event pool/spa heat is requested and paid for we cannot guarantee the temperature as this will vary according to several factors and weather conditions.

SAFETY AND SECURITY: Due to State Fire Regulations, under no circumstances may more than the maximum number of persons identified on the booking form occupy the property.  Children must be supervised at ALL TIMES whilst in the pool area.  Glass is NOT permitted in the pool area.  The Owner, or our management company, reserves the right to enter the premises at any time for whatever reason.

FORCE MAJEURE: We accept no responsibility for, and shall not be liable in respect of loss or changes caused by Force Majeure, e.g. Strikes, Fire, Flood, Closure of Airports, Weather Conditions, War, Riots, Terrorist Activity, or any other event beyond our control.

INVENTORY: The owner in good faith leaves everything in the house for your use. Renter need to take care all the equipments in the house while staying in the house. Any damage or breakages should be reported to the Management Company.

NO SMOKING: The property is non-smoking. If any extra cleaning is needed on fabrics, carpets and furniture etc. to remove tobacco smoke by the Management Company, the cost of cleaning these items will be deducted from your security deposit.

NO PET: No pets are allowed in the property. If any extra cleaning is needed on fabrics, carpets and furniture etc. to remove any pet hair or stain by the Management Company, the cost of cleaning these items will be deducted from your security deposit.
